The bank's lien on the property is registered on the title deed but the bank only becomes the owner of record, if the owner defaults on the loan and the case has gone through the court. So far there is no clear evidence that anything has changed for Thais with foreign spouses buying land. This "loophole" can't be closed without impacting the civil liberties of the Thai spouses to accept gifts and use them how they please.
