» ดร.สาธิต ร่วม ตำรวจ บก.ปคบ. บุกรวบหมอต่างชาติ ลักลอบเปิดคอร์สจัดกระดูกในไทยรัฐมนตรีช่วยว่าการกระทรวงสาธารณสุข ร่วมกับตำรวจ บก.ปคบ. นำทีมเจ้าหน้าที่ เข้าจับกุมแพทย์ชาวต่างชาติในคลินิก 3 แห่ง พื้นที่กรุงเทพฯ และปริมณฑล หลังได้รับร้องเรียนเปิดคอร์สนวดจัดกระดูกโดยไม่มีใบประกอบโรคศิลปะในประเทศไทย เข้าข่ายมีความผิดตามกฎหมายฐานเป็นแพทย์เถื่อน เบื้องต้นสั่งลงโทษ 3 กระทง ทั้งแพทย์และสถานบริการบ่ายวันนี้ (11 พฤศจิกายน 2564) ดร.สาธิต ปิตุเตชะ รัฐมนตรีช่วยว่าการกระทรวงสาธารณสุข และนายแพทย์ธเรศ กรัษนัยรวิวงค์ อธิบดีกรมสนับสนุนบริการสุขภาพ พร้อมตำรวจกองบังคับการปราบปรามการกระทำความผิดเกี่ยวกับการคุ้มครองผู้บริโภค (บก.ปคบ.) แถลงผลการบุกจับเครือข่ายแพทย์ชาวต่างชาติ ลักลอบเข้ามาให้บริการนวดจัดกระดูกในคลินิก 3 แห่ง ย่านศรีนครินทร์ ชิดลม และเมืองทองธานีดร.สาธิต ให้สัมภาษณ์ว่า กรมสนับสนุนบริการสุขภาพ ร่วมกับตำรวจ บก.ปคบ. จับแพทย์จัดกระดูกชาวต่างชาติในสถานบริการ 3 แห่ง หลังได้รับร้องเรียนจากประชาชนว่ามีคลินิกนำแพทย์ต่างชาติมาเปิดคอร์สนวดจัดกระดูก เก็บค่ารักษาตั้งแต่หลักพันจนถึงหลักแสนบาท ซึ่งผู้รับบริการส่วนหนึ่งกังวลว่ามีการขึ้นทะเบียนอย่างถูกต้องตามกฎหมายหรือไม่ ทั้งนี้ การนวดจัดกระดูกโดยบุคคลที่มิใช่แพทย์ หรือผู้ประกอบโรคศิลปะ นอกจากจะส่งผลกระทบต่อสุขภาพร่างกายแล้ว ยังทำให้สูญเสียทรัพย์สิน และเป็นอันตรายถึงขั้นพิการหรือเสียชีวิตได้ จากการตรวจสอบเบื้องต้นพบว่า แพทย์ที่ให้บริการไคโรแพรกติก (Chiropractic) หรือการนวดจัดกระดูก ทั้ง 3 แห่ง ไม่ได้ขึ้นทะเบียนและได้รับใบประกอบวิชาชีพเวชกรรม หรือใบประกอบโรคศิลปะของไทย และแม้จะมีใบประกอบวิชาชีพจากประเทศต้นทาง แต่การที่แพทย์จากต่างประเทศจะให้บริการนวดจัดกระดูกในประเทศไทยได้นั้น ต้องสอบผ่านและได้รับใบประกอบโรคศิลปะของไทยก่อน มิฉะนั้นจะถือว่าเป็นแพทย์เถื่อน ดร.สาธิต กล่าวต่อว่า เบื้องต้นพนักงานเจ้าหน้าที่แจ้งข้อหากับแพทย์ทั้ง 3 แห่ง ในความผิดตามพระราชบัญญัติการประกอบโรคศิลปะ พ.ศ.2542 ฐานประกอบโรคศิลปะศาสตร์ไคโรแพรกติกโดยไม่ได้รับอนุญาต ต้องระวางโทษจำคุกไม่เกิน 3 ปี หรือปรับไม่เกิน 30,000 บาท หรือทั้งจำทั้งปรับ และหากตรวจสอบข้อเท็จจริงพบมีการกระทำที่ก้าวล่วงวิชาชีพเวชกรรม จะถือว่ามีความผิดตามพระราชบัญญัติวิชาชีพเวชกรรม พ.ศ.2525 ฐานประกอบวิชาชีพเวชกรรมโดยไม่ได้ขึ้นทะเบียนและได้รับอนุญาต (แพทย์เถื่อน) ต้องระวางโทษจำคุกไม่เกิน 3 ปี หรือปรับไม่เกิน 30,000 บาท หรือทั้งจำทั้งปรับ ส่วนผู้ดำเนินการสถานพยาบาล พนักงานเจ้าหน้าที่ แจ้งข้อหากระทำผิดตามพระราชบัญญัติสถานพยาบาล พ.ศ.2541 ฐานปล่อยให้บุคคลอื่นซึ่งมิใช่ผู้ประกอบวิชาชีพ หรือผู้ประกอบโรคศิลปะ ทำการประกอบวิชาชีพในสถานพยาบาล ต้องระวางโทษจำคุกไม่เกิน 2 ปี หรือปรับไม่เกิน 40,000 บาท หรือทั้งจำทั้งปรับด้าน นพ.ธเรศ กล่าวต่อว่า ก่อนตัดสินใจรับบริการที่เกี่ยวข้องกับสุขภาพขอให้ประชาชนพิจารณาอย่างถี่ถ้วน อย่าตัดสินใจรับบริการเพียงเพราะผู้ให้บริการเป็นแพทย์ หรือผู้ประกอบโรคศิลปะจากต่างประเทศที่ดูน่าเชื่อถือ เพราะอาจตกเป็นเหยื่อของแพทย์เถื่อนที่มีกระบวนการรักษาหรือเสริมความงามที่ไม่ได้มาตรฐาน และเมื่อเกิดความเสียหายจากการรักษาพยาบาลหรือเสริมความงาม หากแพทย์เหล่านี้หลบหนีกลับประเทศต้นทางจะจับกุมมาดำเนินคดี หรือเรียกค่าเสียหายให้กับประชาชนได้ยาก ทั้งนี้ หากพบแพทย์ หรือผู้ประกอบโรคศิลปะจากต่างประเทศให้บริการรักษาพยาบาล เสริมความงาม หรือให้คำปรึกษาในคลินิก ให้หลีกเลี่ยงการรับบริการ และหากอยู่ในเขตกรุงเทพฯ แจ้งสายด่วน 1426 กรมสนับสนุนบริการสุขภาพ ในวันและเวลาราชการ ส่วนภูมิภาค แจ้งได้ที่สำนักงานสาธารณสุขจังหวัดในพื้นที่ เพื่อดำเนินการตามกฎหมายต่อไป Published caption : The Public Health Ministry and the Consumer Protection Police Division raided three illegal chiropractic clinics in Srinakharin, Chidlom, and Muang Thong Thani after receiving complaints from customers.
