» Published captionPolitical activist Srisuwan Janya, left, yesterday files a petition with the National AntiCorruption Commission against Prime Minister Gen Prayut Chan-o-cha for ‘giving inappropriate gifts.’ Tawatchai Kemgumnerdศรีสุวรรณ จรรยา ร้อง ป.ป.ช. โดยมีนายสุทธิ บุญมี ผู้รับหนังสือ เอาผิด พล.อ.ประยุทธ์ พล.อ.อนุพงษ์ เผ่าจินดา พล.อ.ฉัตรชัย สาริกัลยะ ให้-รับของขวัญ เป็นสุนัขบางแก้วราคาเกิน 3 พัน ผิดกฎหมาย ตามที่พล.อ.ประยุทธ์ จันทร์โอชา นายกรัฐมนตรีนำคณะรัฐมนตรีสัญจรไปประชุมที่จังหวัดพิษณุโลกและสุโขทัยเมื่อวันที่ 25-26 ธ.ค.60 ที่ผ่านมาโดยในระหว่างที่นายกฯ ลงพื้นที่เยี่ยมชมการดำเนินงานของบริษัท ประชารัฐรักสามัคคี พิษณุโลก (วิสาหกิจเพื่อสังคม) จำกัด ก็ได้ให้ความสนใจชมการเพาะเลี้ยงสุนัขพันธุ์บางแก้ว ของกลุ่มผู้เพาะเลี้ยงในพื้นที่ พร้อมกับซื้อลูกสุนัขบางแก้ว 3 ตัว เพื่อนำไปเลี้ยงเอง 1 ตัว และซื้อให้พล.อ.อนุพงษ์ เผ่าจินดา รัฐมนตรีว่าการกระทรวงมหาดไทย พล.อ.ฉัตรชัย สาริกัลยะ รองนายกฯ คนละหนึ่งตัว โดยที่ลูกสุนัขบางแก้วที่นายกฯ ซื้อราคาตัวละ 6,000 บาท แต่นายกฯ ได้ให้เงินไป 25,000 บาท เพราะต้องการให้เป็นขวัญกำลังใจและเงินขวัญถุงแก่ผู้เพาะเลี้ยง ซึ่งการกระทำดังกล่าว ได้ปรากฏเป็นการทั่วไปต่อหน้าสื่อมวลชนและสาธารณะชนนั้น การให้หรือรับของขวัญ ซึ่งเป็นสุนัขดังกล่าว ถือว่าเป็นทรัพย์สินหรือประโยชน์อื่นใดที่มีมูลค่าเกินกว่า 3,000 บาท ถือว่ามีความผิดตามมาตรา 103 แห่งพ.ร.ป.ว่าด้วยการป้องกันและปราบปรามการทุจริต 2542 และแก้ไขเพิ่มเติม ประกอบข้อ 5(2) ของประกาศคณะกรรมการ ป.ป.ช. เรื่องหลักเกณฑ์การรับทรัพย์สินหรือประโยชน์อื่นใด โดยธรรมจรรยาของเจ้าหน้าที่ของรัฐ 2543 และระเบียบสำนักนายกรัฐมนตรีว่าด้วยการให้หรือรับของขวัญของเจ้าหน้าที่รัฐ 2544 ซึ่งบัญญัติไว้ชัดเจนว่า “ห้ามมิให้เจ้าหน้าที่ของรัฐผู้ใดรับทรัพย์สินหรือประโยชน์อื่นใดจาก บุคคล นอกเหนือจากทรัพย์สินหรือประโยชน์อันควรได้ตามกฎหมาย หรือกฎ ข้อบังคับที่ออกโดย อาศัยอํานาจตามบทบัญญัติแห่งกฎหมาย เว้นแต่การรับทรัพย์สินหรือประโยชน์อื่นใดโดยธรรมจรรยา ตามหลักเกณฑ์และจํานวนที่คณะกรรมการ ป.ป.ช. กําหนด” ซึ่งคณะกรรมการ ป.ป.ช. ได้ประกาศกำหนดไว้แล้วว่าทรัพย์สินจะมีมูลค่าเกินกว่า 3,000 บาทไม่ได้ ที่สำนักงาน ป.ป.ช. ถนนสนามบินน้ำ อ.เมือง จ.นนทบุรี
